Building Permits

Any season is a great time to be building or making home improvements. Below are some items that need a building permit in the Town of Middletown. If you have any questions about an item that is not listed below, please reach out at 845-586-2344.

If you are ready for a permit, please see our portal.

Building

  • New decks or extensions on current decks, also if adding a roof or enclosing

  • Replacements of roofs

  • Modifying or adding to any electrical, heating, cooling or plumping system

    • Examples: Hot tub, Mini Splits, Sauna, wood burning appliance

  • Non-portable generators

  • Solar

  • Insulation

  • Window replacements that are a different size than they are currently

  • Sheds or outbuildings larger than 144sq ft

  • Any major renovations, additions or demolition

  • Inground pools or aboveground pools deeper than 2ft

  • New home or garage construction

  • Work on any load bearing wall, adding doors to existing walls

  • Carports if 3 or more sides are enclosed

Zoning

  • Sheds or carports under 144 sq ft

  • Changing property type- for example, residential to commercial

  • Fencing or signs

  • Subdivisions

  • Boundary adjustments

Subdivision, Zoning, and Deeds

The Town of Middletown has zoning laws and subdivision regulations. Some projects may require site plan review. See the Planning Board page for more information.

Refer to your deed to determine what, if any, restrictions may apply. Sample restrictions range from the size and style of dwelling to restrictions on farm animals. 

Deed restrictions and their compliance are not reviewed or considered when issuing building permits and enforcement of deed restrictions are a civil matter.

Septic System Projects

Because of our location in the New York City Watershed, the Department of Environmental Protection (DEP) requires septic approval prior to subdivision or construction. A building permit will not be issued without DEP septic approval.

For new septic projects, contact the NYC DEP: (607) 363-7000

Septic replacement, upgrade, or other information, contact the Catskill Watershed Corporation (CWC): (845) 586-1400 or visit the CWC online.

As indicated on the building permit application, applications for new house construction must include NYC DEP septic plan approval. If applying for an addition that will include a bedroom(s), written approval from DEP must be included approving use of the existing system.
